THESE TERMS CONTAIN A BINDING ARBITRATION CLAUSE AND A CLASS ACTION WAIVER. PLEASE READ SECTION 7.

1. Agreement

These Terms and Conditions ("Terms") govern your use of FreeWindshieldReplacement.com, including our website, forms, phone lines, text messages, and advertisements (the "Service"). By using the Service or submitting a request, you agree to these Terms. You confirm that you are at least 18, that you own the vehicle or are authorized to arrange service for it, and that the information you give us is accurate.

2. Who we are

FreeWindshieldReplacement.com is a marketing and referral company, not an auto glass company or an insurance company. All glass replacement, repair, mobile service, and calibration is performed by independently owned and operated auto glass companies ("Service Providers").

- Independent companies. Service Providers are not our employees, contractors, or agents, and we are not their agent. We do not supervise or control their work.

- Our advertising. Statements such as "we come to you," "our technicians," or "our glass" describe services performed and products supplied by a Service Provider.

- Your contract. Any agreement for glass or calibration work is between you and the Service Provider. We are not a party to it.

- No guarantee of service. Submitting a request does not guarantee that a Service Provider is available, will accept your job, or will arrive at a particular time.

- Compensation. You do not pay us anything. We may receive compensation from Service Providers for referrals. You are free to use any auto glass company you choose.

- Screening. We confirm that each Service Provider is a registered business when we begin working with it. We do not guarantee any Service Provider's licensing, insurance, workmanship, or results.

3. What "free" means

"Free" and "no cost" mean that an eligible driver may have no out-of-pocket cost for a windshield replacement covered by their insurance. They are not a guarantee that your replacement will be free.

- Eligibility. Under Florida law (Section 627.7288, Florida Statutes), the deductible does not apply to windshield damage on a Florida auto policy that includes comprehensive coverage. Liability-only policies generally do not cover glass. Other glass, such as side or rear windows, may be subject to your deductible.

- Your insurer decides. Coverage and payment are determined by your insurer and your policy. We do not file, adjust, or guarantee insurance claims, and we make no statement about how a claim may affect your policy or premiums.

- You may owe the Service Provider. If your insurer denies or only partly pays a claim, you may be responsible for the Service Provider's charges. We are not.

- No incentives. We do not offer cash, gift cards, rebates, or anything else of value in exchange for making an insurance claim.

4. What the Service Provider is responsible for

The Service Provider, and not FreeWindshieldReplacement.com, is solely responsible for its services. Any claim about the following must be made to the Service Provider and its insurer:

- Glass and parts. The glass, moldings, adhesives, and parts used. Glass may be original equipment or aftermarket. Descriptions such as "OEM quality" reflect what Service Providers tell us they generally offer, so confirm the brand and type before work begins.

- Workmanship. The quality of the installation, including leaks, wind noise, defects, and safe drive-away times.

- Calibration. Telling you whether your vehicle's cameras and sensors (ADAS) need calibration, and performing or arranging it. Calibration may cost extra and may be done by a different company. Do not rely on driver assistance features until required calibration is confirmed complete.

- Warranties. Any warranty on glass, parts, labor, or calibration. We provide no warranty of our own.

- Damage and injury. Damage to your vehicle, personal property, or premises, bodily injury, and any wrongful act by the Service Provider's staff.

- Scheduling. Appointment times, delays, cancellations, and missed appointments.

- Billing and payment. Estimates, invoices, charges, insurance billing and claims, fees, and refunds. We do not bill you, process payments, or handle insurance proceeds.

If you have a dispute with a Service Provider, you must resolve it with the Service Provider. We may help you contact them as a courtesy, but helping does not make us responsible and does not change these Terms.

5. Calls, texts, and your information

When you submit a request, you ask to be contacted about it. You agree that we and the Service Provider your request is referred to may call, text, and email you at the contact information you provide about scheduling, insurance verification, reminders, and follow-up.

- Marketing messages. We send automated or prerecorded marketing calls or texts only if you gave separate consent on our form. That consent is not a condition of purchase.

- Opting out. Reply STOP to any text, or tell us on any call, to stop. Reply HELP for help. Message and data rates may apply, and message frequency varies.

- Your number. You confirm that the phone number you give us is yours, and you are responsible for claims that result from giving us someone else's number.

- Service Provider contacts. Each Service Provider is responsible for its own calls, texts, and emails to you.

- Recording. Calls may be recorded for quality and training, where permitted by law.

- Sharing. We share your name, contact details, vehicle details, and insurance information with Service Providers and, where needed, your insurer. See our Privacy Policy at [Privacy Policy link].

6. Limits on our liability

THE SERVICE IS PROVIDED "AS IS," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

TO THE FULLEST EXTENT PERMITTED BY LAW, FREEWINDSHIELDREPLACEMENT.COM AND ITS OWNERS, OFFICERS, EMPLOYEES, AND CONTRACTORS ARE NOT LIABLE FOR:

- THE ACTS, ERRORS, OR OMISSIONS OF ANY SERVICE PROVIDER OR INSURER, INCLUDING ANYTHING LISTED IN SECTION 4; OR

- ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF USE OF YOUR VEHICLE OR LOST WAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED $100.

You release us from all claims arising from a Service Provider's services or from your dispute with a Service Provider or insurer. Nothing in these Terms limits liability that cannot be limited by law, or limits your rights against a Service Provider or your insurer.

7. Disputes with us

Any dispute between you and us will be decided by binding individual arbitration under the American Arbitration Association's Consumer Arbitration Rules, not in court, except that either of us may use small claims court. You and we may bring claims only individually, and not as part of a class action. These Terms are governed by Florida law.

8. General

We may update these Terms by posting a revised version on this page. Changes do not apply to disputes that arose before they were posted. If any part of these Terms is found unenforceable, the rest remains in effect. These Terms and our Privacy Policy are the entire agreement between you and us about the Service.
